Terms and Conditions

Definitions

  • Bhavanahhf.com: Bhavanahhf, headquartered at Calle Granate Fase 2, Bloque F3B Los Hidalgos, Manilva 29692, Spain.

  • Client: The person with whom Bhavanahhf has entered into an agreement.

  • Parties: Bhavanahhf and the client together.

  • Consumer: A client who is also a natural person acting as a private individual.


Applicability of the General Terms and Conditions

These terms and conditions apply to all offers, quotes, activities, orders, agreements, and deliveries of services or products made by or on behalf of Bhavanahhf.
The parties may only deviate from these terms if explicitly and mutually agreed upon in writing.
The parties expressly exclude the applicability of any additional and/or divergent terms and conditions from the client or third parties.


Prices

All prices used by Bhavanahhf are in euros, include VAT, and exclude any other costs such as administrative fees, taxes, and travel, shipping, or transportation expenses unless expressly stated otherwise.
Bhavanahhf reserves the right to adjust product prices on its website or advertised elsewhere at any time.
Cost increases in product prices or their components, not foreseen at the time of the offer or contract conclusion, may lead to price changes.
Consumers have the right to rescind the contract due to a price increase as stated in clause 3, except if the increase is due to legal regulations.


Samples and Models

If the client receives a sample or model of a product, no rights may be derived from it beyond serving as an indication of the nature of the product, unless otherwise explicitly agreed by the parties.


Payments and Payment Terms

Bhavanahhf may require an advance payment of up to 50% of the agreed amount upon contract conclusion.
Subsequent payments after delivery must be made by the client within 7 days after receiving the product.
Payment deadlines are strict. If the client does not pay by the deadline, they will automatically be in default without further notice from Bhavanahhf.
Bhavanahhf reserves the right to condition delivery on immediate payment or demand guarantees for the total amount of the service or product.


Consequences of Late Payment

If the client fails to pay within the agreed period, Bhavanahhf has the right to charge legal interest of 2% per month for non-commercial transactions from the due date, counting any partial month as a full month.
Additionally, the client must cover extrajudicial collection costs and any damages caused to Bhavanahhf.
Collection costs will be calculated according to the Decree on Compensation for Extrajudicial Collection Costs.
In case of delayed payment, Bhavanahhf may suspend its obligations until the client fulfills their payment obligation.
In the event of liquidation, bankruptcy, seizure, or suspension of payments by the client, Bhavanahhf’s claims become immediately payable.
The client’s refusal to cooperate in the execution of the agreement does not exempt them from paying the agreed price.


Reflection Period / Right of Withdrawal

The consumer has the right to withdraw from the contract within 14 days without giving any reason. This period starts the day after the consumer or a third party designated by the consumer (other than the carrier) receives the product.
During this period, the consumer must handle the product and its packaging carefully, only unpacking or using the product as necessary to determine whether to keep it.
If the consumer exercises their right of withdrawal, they must return the product, including all accessories, in its original condition and packaging, following Bhavanahhf’s clear return instructions.
The consumer is liable for any depreciation in the product’s value caused by handling beyond what is necessary.
The consumer is not liable for value reduction if Bhavanahhf failed to provide legally mandatory withdrawal information before the contract.


Returns and Exchanges

If the consumer exercises their right of withdrawal, they must notify Bhavanahhf within the 14-day reflection period at bhavanahhf@gmail.com.
The consumer must return the product within 14 days of the notification to the return address provided by Bhavanahhf. The product must be in its original condition and packaging, following Bhavanahhf’s instructions.
Bhavanahhf will refund all payments made by the consumer, excluding shipping costs, within 14 days of the withdrawal notification. Refunds may be withheld until the product is returned or the consumer provides proof of return.
Refunds will be made using the original payment method unless the consumer agrees to an alternative. Refunds are free of charge.
If the consumer chooses a more expensive delivery method than the standard, Bhavanahhf is not obliged to reimburse the additional costs.


Exclusions

Products that are damaged, washed, or modified are not eligible for return or exchange. Consumers are advised to inspect products carefully before returning them.
