Definitions
 

Bhvanahhf.com: Bhavanahhf, based: Calle Granate Fase  2, Bloque F3B Los Hidalgos, Manilva 29692, Spain
Customer: The person with whom Bhavanahhf has entered into an agreement.
Parties: Bhavana and the customer together.
Consumer: A customer who is also an individual acting as a private person.
 


Applicability of General Terms and Conditions
 

  1. These terms and conditions apply to all offers, quotations, activities, orders, agreements, and deliveries of services or products by or on behalf of Bhavanahhf.
  2. Parties may deviate from these terms only if explicitly and mutually agreed in writing.
  3. Parties expressly exclude the applicability of additional and/or deviating terms and conditions of the customer or third parties.
     

Prices
 

  1. All prices used by Bhavanahhf are in Euros, inclusive of VAT, and exclusive of any other costs such as administration fees, levies, and travel, shipping, or transportation costs unless explicitly stated otherwise.
  2. Bhavanahhf reserves the right to adjust prices for its products on its website or announced elsewhere at any time.
  3. Price increases of product cost prices or their components, unforeseen at the time of the offer or conclusion of the agreement, may result in price changes.
  4. The consumer has the right to dissolve the agreement due to a price increase as referred to in clause 3, unless the increase is due to legal regulations.
     

Samples and Models
 

If the customer receives a sample or model of a product, no rights can be derived from it other than it serving as an indication of the nature of the product, unless explicitly agreed otherwise by the parties.
 


Payments and Payment Terms
 

  1. Bhavanahhf may require a down payment of up to 50% of the agreed amount when entering into the agreement.
  2. Post-delivery payments must be made by the customer within 7 days of receipt of the product.
  3. Payment terms are considered strict deadlines. If the customer fails to pay by the final date, they are automatically in default without further notice from Bhavanahhf.
  4. Bhavanahhf reserves the right to make delivery conditional upon immediate payment or demand security for the total service or product amount.
     

Consequences of Late Payment
 

  1. If the customer does not pay within the agreed term, Bhavanahhf is entitled to charge statutory interest of 2% per month for non-business transactions from the due date, with part of a month being calculated as a full month.
  2. In addition, the customer will owe extrajudicial collection costs and any damages to Bhavanahhf,
  3. The collection costs are calculated based on the Decree on Compensation for Extrajudicial Collection Costs.
  4. In case of late payment, Bhavanahhf may suspend its obligations until the customer fulfills their payment obligation.
  5. In case of liquidation, bankruptcy, seizure, or suspension of payment at the customer's end, claims by Bhavanahhf become immediately due.
  6. Refusal by the customer to cooperate in the execution of the agreement does not exempt them from paying the agreed price.
     

Cooling-off Period / Right of Withdrawal
 

  1. The consumer has the right to withdraw from the agreement within 14 days without giving reasons. This period starts the day after the consumer or a third party designated by the consumer (not the carrier) receives the product.
  2. During this period, the consumer must handle the product and packaging with care, only unpacking or using the product as necessary to determine whether to keep it.
  3. If the consumer exercises their right of withdrawal, they must return the product, including all accessories and in its original condition and packaging, in accordance with Bhavanahhf clear return instructions.
  4. The consumer is liable for any depreciation in the product’s value caused by handling beyond what is permitted.
  5. The consumer is not liable for value reduction if Bhavanahhf did not provide mandatory legal information about withdrawal rights prior to the agreement.
     

Returns and Exchanges
 

  1. If the consumer exercises their right of withdrawal, they must notify Bhavanahhf within the 14-day reflection period via info@bhvanahhf.com.
  2. The consumer must return the product within 14 days after notification to the return address provided by Bhavanahhf. The product must be in original condition and packaging, following clear instructions provided by Bhavanahhf.
  3. Bhavanahhf will reimburse all payments from the consumer, Excluding any delivery costs, within 14 days of receiving the withdrawal notification. Refunds may be withheld until the product is returned or the consumer provides proof of return.
  4. Reimbursements will be made using the original payment method unless the consumer agrees to an alternative method. Refunds are free of charge.
  5. If the consumer chooses a more expensive delivery method than the standard delivery, Bhvanahhf is not required to reimburse additional costs.
     

Exclusions
 

Products that are damaged, washed, or altered are not eligible for return or exchange. Consumers should carefully inspect products before returning them.
